When is my pre-nup at risk of a challenge? Defrauding a Creditor.

The Federal Circuit and Family Court of Australia has power to ‘set aside’ or cancel a financial agreement in a variety of circumstances. In this series, we explore some of the common ways that these agreements can be challenged.

If you entered an agreement with the purpose a defeating and defrauding a creditor (like the ATO, with an imminent bankruptcy or a company liquidation event) and everything was transferred out of reach of that creditor, that person or entity may be able to claw back and undo the deal you thought you had made.
