Our team has assisted thousands of clients obtain Australian Permanent Residence and Citizenship even when they have previously been refused. The following is an example in relation to a client who had a Partner visa application refused when they engaged another lawyer. 

There were multiple reasons for the refusal, including failure to meet the health criteria but it also involved character (police convictions). Nevett Ford was able to assist and advise the client through the Administrative Appeals Tribunal (AAT) appeals process and then the Ministerial Intervention request process to obtain Australian Permanent Residence when the client had previously been advised by another lawyer that they had no chance of success.

Case study: Visa cancellation, Review to Administrative Appeals Tribunal

Client had visa cancelled because incorrect information had been provided on application form many years before. In the meantime, the client had written to the Department acknowledging the error on the form and providing correct information. This notification also occurred a number of years before the decision was made to cancel and the client had assumed that the Department had elected not to take action and as a result, made a substantial commitment to Australia and his community in particular. A review application to the Administrative Appeals Tribunal was successful, in large part due to the fact that the Tribunal was mindful of the impact of a cancellation on the young children of the applicant.
Case study: S/C482 skills Refusal: Review to Administrative Appeals Tribunal

Applicant had applied to the Department for a S/C482 Visa on the basis of being an ‘in-house’ accountant for the nominating business. The Department refused the application on the basis claimed that it was ‘non-genuine’. The business used outside accountants for taxation work and the Department’s view was that the duties associated with the position were more bookkeeping related compared to those typically associated with the role of Accountant. On review it was Demonstrated to the Tribunal that the business was a large one with a turnover in the tens of millions of dollars. Further, a lot of its sales revenues were derived from overseas, and there were multiple issues to be concerned with relating to exchange rates and frequent price adjustments on stock. Managing these issues was the principal role of the internal accountant and was clearly distinguishable from the work which was sent to the external accountants to be done. Review application was successful
