MANDATORY CODE OF CONDUCT FOR LANDLORDS & TENANTS

The Australian Government has introduced a mandatory Code of Conduct for landlords and tenants, in an endeavour to assist and encourage negotiation of varied lease terms to give each party a better chance of surviving the effects of the measures to combat the COVID-19 crisis, which have caused significant reduction in trade for many businesses.

There are certain guidelines and principles relevant to these negotiations conducted under the Code and you will find further information in our article below.

TENANT PACKAGE 1

Includes an assessment of whether the Code applies and a helpful summary of the likely effect of the Code on your lease, together with a proposal with which to approach the landlord

TENANT PACKAGE 2

As above in Package 1, together with a comprehensive review of your lease and advice on terms and obligations

LANDLORD PACKAGE

Includes an assessment of the application of the Code and a summary of your obligations and potential exposure, and preparation of a proposal to the tenant or a response to a proposal from the tenant in accordance with the Code (including a request for relevant information)
