Previously, one of the main requirements for a Subclass 189 New Zealand pathway applicant is to demonstrate a taxable income above the Temporary Skilled migration Income threshold (‘TSMIT’) for at least five (5) years at the time of submitting a valid application—the TSMIT amount is $53,900.
This requirement has created difficulties for some New Zealand applicants, and has resulted in them being unable to apply for their permanent residency in Australia.
However, this criteria has recently been reformed by the Government to reduce the financial requirement period to at least three (3) years of the last five (5) income years, including the most recent year. This is great news for New Zealand stream applicants as this new announcement may provide more leniency in the income threshold requirement for any applicants who were previously unable to apply under this visa stream.
The Department of Home Affairs has not announced when the new criteria will start as a legislative instrument will need to be drafted and published prior to commencement.
Once the above is finalised, the new requirements for the Subclass 189 New Zealand stream would be:
- Hold a Subclass 444 Special Category visa
- Have been residing in Australia as a ‘usual resident’ for at least five (5) years, and entered Australia on or before 19 February 2016
- Have a taxable income that is above the TSMIT threshold for at least three (3) years out of last five (5) including the current financial year when submitting the application
- Good character and good health
