When Probate is not required in Victoria

Probate can be a lengthy and costly process in Victoria, but did you know that in some cases, it’s not required at all?

Understanding when a Grant of Probate is unnecessary can save you time, money, and stress when dealing with the estate of a loved one.  Whether you’re an executor or a beneficiary, knowing when probate isn’t needed can help streamline the entire estate administration process.

Below are some situations where a Grant of Probate may not be required in Victoria and how you can simplify managing an estate without going through the formal court process.

Small Estates: When Probate May Not Be Required

In Victoria, if the estate is small, probate may not be necessary.  A small estate typically refers to situations where estate assets are under a specific threshold, which can change over time and is different for each institution such as banks, etc.

For estates with a limited amount of assets, such as a modest bank balance or a few personal items, you might not need to go through the formal probate process.

The key here is that the total value of the estate is considered.  Even if the deceased person had a small amount of money in a bank account or owned a few personal items, probate may not be required.  This can make the estate administration process much simpler and more affordable.

If a bank or institution insist that a Grant of Probate be received, you can receive assistance from the Probate Office.  If the total value of the assets is under $129,850, the Probate Office can assist you with the application process.

Jointly Owned Assets: No Need for Probate

Probate is often unnecessary when assets are jointly owned.  In Victoria, if the deceased person owned property or assets jointly with another person (such as a home or a bank account), those assets automatically pass to the surviving co-owner without the need for a Grant of Probate.

For example, if a married couple owned their home jointly, the surviving spouse would automatically inherit the property upon the death of the other, without the need for probate. The same applies to joint bank accounts: the surviving account holder would have access to the funds without needing to apply for probate.

Superannuation and Life Insurance Benefits: Probate May Not Be Required

Probate is often not needed when the deceased person’s estate consists primarily of superannuation funds or life insurance payouts.  This is because these assets are typically paid directly to a nominated beneficiary, bypassing the probate process altogether.

For example, if the deceased had nominated a specific person (such as a spouse or child) to receive their superannuation or life insurance benefits, those funds will go usually go straight to the nominated beneficiary without requiring probate to validate the will.  This can significantly speed up the process and ensure the beneficiary gets the funds without unnecessary delays.

The process gets more complicated should there be no nominated beneficiary or, the nomination is not valid.  In these instances, it is up to each institution to advise whether probate is needed or not.
