Family violence intervention orders (FVIOs), domestic violence orders (DVOs), apprehended violence orders (AVOs), and personal safety intervention orders (PSIOs), whatever your local area calls these Orders, they are an integral part of the family law system.
All these orders work to protect people who say they have experienced some incident of family violence or personal safety incident, and are afraid they will again. Usually they apply between family members or people who were in a relationship, but we also work with people who have neighbourhood disputes regarding fences, arguments, and aggressive behaviour from neighbours.
Your local Court will consider making urgent orders to protect someone just based on their statements alone. Once that occurs or does not occur, the person alleged to have caused the incident will be given notice of the application, and will have the opportunity to dispute the allegations or consent to an order without admitting anything.
It is important to contextualise these Orders – that is, what impact will this have on my other family law issues, or is this a separate issue that I need to focus upon.
Our lawyers are experts in advising on these Orders, advising on urgent orders and police intervention, and experts in assisting you with criminal charges that might arise if you breach an order like this. Call us now to find out what you should be doing, if you need an order or if you have just found out someone is taking one out against you.
